AIZAWL JUDICIAL DISTRICT: AIZAWL, MIZORAM
INFORMATION UNDER SECTION 4 (1) (b) OF THE RIGHT TO INFORMATION ACT, 2005
The District & Sessions Judge is the head of the Department / Organisation assisted by three Additional District & Sessions Judge, three Senior Civil Judges, one Chief Judicial Magistrate and five Civil Judges –cum- JMFC in Aizawl District Court, one Chief Judicial Magistrate-Cum-Senior Civil Judge assisted by one Civil Judge-Cum- JMFC at Kolasib, one Chief Judicial Magistrate-Cum-Senior Civil Judge assisted by one Civil Judge-Cum- JMFC at Champhai, one Civil Judge-Cum-JMFC at Serchhip and one Civil Judge-Cum-JMFC at Mamit is established.
Each court is assisted by the Peskars, Computer Operators and Peons (IVth Grade Staff). Allotment of Stenographer to District & Sessions Judge (Grade- I), Addl. District & Sessions Judge (Grade- I or II) and CJM/Sr. Civil Judge (Grade-II or III) of one each is also guided by the Office Memorandum, Govt. of Mizoram under No. A. 12011/6/99-PAR (SSW), the 7th May, 2010 [Vide, Part – II (A) of the Mizoram Gazette, Vol. XXIX; Dt. 28.5.2010, Issue No. 22, pp. 8&9]
Account Branch deals all financial transactions of the Department, Establishment Branch deals service matters and general administration of the department, Record Room and Library is also well functioning. E-Court Project is persuaded under a separate Nodal Officer. Malkhana administration is functioning under its Branch Officer.
The meeting of the ‘Committee on Security Arrangement of Protected Persons’ held in the Office Chamber of Home Secretary, Govt. of Mizoram on 30.10.2009 circulated the resolutions under No. D. 32019/14/09-HM (S), Dated Aizawl, the 19thNovember, 2009 also allotted one PSO to each Chief Judicial Magistrates.

Various courts in District Judiciary is mainly governed by the followings-

(13) The Mizoram Civil Courts Act, 2005
(14) The Court Fees (Mizoram Amendment) Act, 1996
(15) The Mizoram (Appointment, duties, fees etc. of Government Advocates) Rules, 1995
(16) The Mizoram Protection of Interests of Depositors (In Financial Establishment) Act, 2002 etc. etc.
Besides the above, permission for delayed registration of Births and Death under the Registration of Births and Deaths Act, 1969 (No. 18 of 1969) read with the Mizoram Registration of Birth and Death Rules, 2007 is issued by the court of JMFC.
The Vigilance Committee at District level is formed under the Chairmanship of District & Sessions Judge to vigil on embezzlement, malpractices and corruption in the organization.
DISTRICT LEVEL COMMITTEE ON COURT INFRASTRUCTURE
As per the decision of Hon’ble Supreme Court Dt. 12/7/2010 in the case of All India Judges Association & Ors. Vs. Union of India & Ors. in IA No. 279 of 2010 arising out of W.P. (C) No. 1022/1989, the ‘District Level Committee on Monitoring and Development of Infrastructure in Subordinate Judiciary’ chaired by the District Judge is constituted under Notification No. C. 18015/32-A/2010-LJC, the 26th August, 2010 (Vide, the Mizoram Gazette, Ext. Ordinary, Vol. XXXIX, Dt. 30.8.2010, Issue No. 321).
SALARIES AND ALLOWANCES:
In compliance with the Judgment of Hon’ble Supreme Court in All India Judges Association & Ors. Vs. Union of India & Ors. (2002) 4 SCC 247 and the report of First National Judicial Pay Commission, November, 1999 headed by Justice K. Jagannadha Shetty, the report of One Man Commission headed by Justice E. Padmanabhan (Retd.) submitted on 17.7.2009 and the directions of Hon’ble Supreme Court on 7.4.2010, 4/5/2010 in IA No. 244 of 2010 arising out of W.P. (C) No. 1022 of 1989 (All India Judges Association & Ors. Vs. Union of India & Ors), the Government of Mizoram notified the salaries and allowances of Judicial Officer under No. A. 11011/2/98-FIN (PRU)/2, the 18th Aug., 2010 (Vide, the Mizoram Gazette, Ext. Ordinary, Vol. XXXIX, Dt. 23.8.2010, Issue No. 306) as under-

Telephone connections are facilitated according to the Office Memorandum No. D. 25011/1/89-GAD, Dated Aizawl, the 3rd October, 2008, Conveyance Allowances and License fee exemption in Govt. Quarter is also notified under No. C. 18013/3/2002- F. Est: Dated Aizawl, the 29th August, 2006, Subscription of Newspapers and Magazines are governed by the Office Memorandum No. A. 60011/106/90- GAD, Dated Aizawl, the 16th April, ’98. Other allowances like Water and Electric Charges, Encashment of leave etc. are notified under No. C. 18013/3/2002- F. Est: Aizawl, the 12th April, 2006 with subsequent modifications under No. A. 11011/2/98-FIN (PRU)/2, the 18th Aug., 2010 (Vide, the Mizoram Gazette, Ext. Ordinary, Vol. XXXIX, Dt. 23.8.2010, Issue No. 306).
The Salaries and Allowances of Ministerial Staff are governed by the ‘Mizoram (Revision of Pay) Rules, 2010’ under Notification No. G. 12017/2/2008- FIN (PRU)/A, the 6th August, 2010 [Vide, the Mizoram Gazette, Ext. Ordinary, Vol. XXXIX Dt. 9.8.2010, Issue No. 276].
